Documents required to obtain a residence permit in Spain
These are the documents you will be required to submit:
- Valid passport or document of entry to Spain.
- Residence visa issued by the consulate or embassy of your country of origin.
- Duly apostilled criminal record certificate.
- Justification of family ties, in case of applying for a residence permit for family reunification.
- 3 passport-size photographs in colour and on a white background.
Temporary Residence
The temporary residence permit in Spain authorizes any person to remain in the territory of that country for a period of time greater than ninety (90) days, and less than five (5) years.
Thus, the temporary residence permit will be granted to immigrants who are in Spanish territory and who apply for the following cases:
Temporary residence without work permit
This is requested before entering Spain, i.e. in your country of origin.
You must submit an application to the Spanish embassy and prove that you have sufficient financial capital to cover the costs of your stay and your return.
You will also have to prove your economic capacity if your trip is accompanied by your family or spouse.
In any case, you must have a criminal record and not be prohibited from entering Spain.
Residence by family reunion
When it comes to obtaining a residence by family ancestry, there are usually two situations:
Temporary residence due to family re-grouping
This is requested when it is a first-degree ancestry, i.e., children or spouse with legal residence in Spain, for at least one (1) year.
At the same time, you must have an authorization to stay in Spanish territory for another year.
Independent residence of regrouped relatives
In this case, they are involved in the application to the Spanish state, 2 legal figures; the residence and the work permit.
That is to say, an independent residence of the regrouping family member is requested in order to declare a self-employed relationship.
In both cases, the application for temporary residence due to family reunification must be made at the nearest Aliens Office.
Persons who have been in Spain for a minimum period of three (3) years may also apply to stay in Spain.
Considering that, during that time, the citizen has entered the labour market or has obtained a family relationship with a Spanish resident.
It is important for you to know that all temporary residence permits can be renewed when you need it, but always for successive periods and will be valid for two (2) years.
